APPA Signs Amicus Brief filed by NACUBO Opposing NIH’s Indirect Cost Rate Cap

APPA is proud to stand with NACUBO, COGR, and 16 other national associations and organizations in signing an amicus brief in support of lawsuits challenging the National Institutes of Health’s (NIH) decision to cap indirect cost reimbursements at 15%.

This marks the first amicus brief in NACUBO’s 63-year history and reflects the unified concern across the higher education sector about the long-term impact of this policy shift. The lawsuits, led by the American Council on Education and supported by multiple states and institutions, argue that NIH’s unilateral decision is both unlawful and harmful to research capacity.

“From advances in cancer treatments to the very technologies we use daily, our colleges and universities drive innovation,” said NACUBO President & CEO Kara D. Freeman. “By capping indirect cost rates, the federal government jeopardizes that progress.”

Institutions already invest heavily in federally sponsored research—an estimated $28 billion of institutional funds in FY2023 alone. The ability to negotiate fair indirect cost rates ensures that they can sustain this investment. APPA’s support underscores our commitment to a research environment that enables both innovation and infrastructure sustainability.
